PsyTest.health is a psychological testing platform that provides:
- University-developed psychological assessments
- AI-powered analysis and recommendations
- Test administration and result management for corporations
- Research opportunities for universities
- Individual self-assessment tools
2.1 Nature of the Service - Important Limitations
Our Platform is NOT a diagnostic tool and does NOT make health-related conclusions.
PsyTest.health is designed as an assessment and evaluation tool that helps:
- Individuals better understand themselves through self-assessment
- Organizations evaluate whether a candidate is suitable for a position
- HR professionals make more informed decisions in recruitment and team management
- Users gain insights into personality traits, cognitive abilities, and behavioral patterns
Critical Limitations:
- NOT a Medical or Clinical Diagnostic Tool: Our Service does not provide medical diagnoses, clinical assessments, or mental health evaluations. We do not make conclusions about your health status, mental health conditions, or medical conditions.
- NOT a Substitute for Professional Evaluation: Our tests are not a replacement for professional psychological evaluation, medical consultation, or clinical assessment by qualified healthcare providers.
- Assessment Tool Only: The Platform serves as an informational and evaluative tool. All test results, AI-generated recommendations, and analyses are provided for assessment purposes only.
- Human Decision-Making Required: All final, key conclusions and decisions remain the responsibility of the human user. Whether in recruitment, self-assessment, or organizational decisions, the ultimate judgment and interpretation of results must be made by qualified professionals or the individual user, not by the Platform or its AI systems.
- No Health Status Determinations: We explicitly do not make any determinations about your physical or mental health status. Our assessments focus on personality traits, cognitive patterns, and behavioral tendencies, not health conditions.
Intended Use: The Platform is intended to be used as a supplementary tool that provides insights and data points to support human decision-making processes. It is designed to enhance understanding and inform decisions, but all final conclusions remain with the human decision-maker.
3. User Accounts and Registration
3.1 Account Creation
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
- Be at least 18 years old, or have parental/guardian consent if under 18
- Have the legal capacity and authority to enter into these Terms
- Not create an account if you are prohibited from using the Service by applicable laws
You represent and warrant that all information you provide is accurate, truthful, and that you have the right to provide such information.

3.3 Referral Codes
If you receive a referral code to take a test (e.g., as a job applicant), you may use that code during registration. The referral code links your account to a specific test or assessment opportunity. You agree to use referral codes only for their intended purpose.
4. User Responsibilities and Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Share your account credentials with others
- Use automated systems (bots, scrapers) to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Service in any way that could harm, disable, or impair the Platform
- Use test results or AI output as the sole basis for critical decisions (hiring, medical, legal, or life-altering decisions) without additional professional evaluation
- Use the Service to discriminate against individuals based on protected characteristics
- Misrepresent or misuse test results or AI recommendations
- Use the Service for purposes it was not designed for (e.g., clinical diagnosis, legal evidence, medical treatment decisions)
4.1 Prohibited Uses
You explicitly agree NOT to use the Service:
- As a substitute for professional medical, psychological, or clinical evaluation
- As evidence in legal proceedings without proper professional validation
- To make medical or health-related decisions without consulting qualified healthcare providers
- To discriminate against individuals in violation of employment, civil rights, or anti-discrimination laws
- As the sole basis for hiring, firing, or making critical employment decisions without additional evaluation
- To violate any individual's privacy rights or confidentiality obligations
- In any manner that could create liability for PsyTest.health or its developers
If you use the Service in any prohibited manner, you agree to indemnify and hold harmless PsyTest.health, its developers, employees, and partners from any resulting claims, damages, or liabilities.
5. Intellectual Property Rights
5.1 Our Content
All content on the Platform, including but not limited to text, graphics, logos, software, and test materials, is the property of PsyTest.health or its licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 University Test Content
Psychological tests provided by university partners remain the intellectual property of those universities or their designated rights holders. Use of these tests is subject to the terms agreed upon with the university partners.
5.3 Your Content
You retain ownership of any content you submit to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing and improving the Service.
6. Test Results and Data
6.1 Result Accuracy and Interpretation
While we strive for accuracy, psychological assessments are tools that provide insights and should not be considered definitive. Results may vary and should be interpreted in context by qualified professionals.
Important: Test results from our Platform:
- Are assessment data points, not diagnostic conclusions
- Do not constitute health status determinations or medical evaluations
- Should be interpreted by qualified professionals in the context of recruitment, organizational decisions, or personal development
- Require human judgment for final decision-making
- Are supplementary information to support, not replace, human decision-making processes
All final conclusions about candidate suitability, personal development needs, or any other decisions based on test results remain the sole responsibility of the human decision-maker (HR professional, individual user, or qualified evaluator).
6.2 Result Ownership
Test results belong to the user who took the test. However:
- If you take a test through a corporate referral, results may be shared with the referring organization as part of the assessment process
- Aggregated, anonymized data may be used for research and platform improvement
6.3 Data Retention
We retain your test results and account data in accordance with our Privacy Policy and applicable data protection laws (GDPR, CCPA). You may request deletion of your data subject to legal and contractual obligations.
7. AI-Powered Features
7.1 Third-Party AI Services
Important: Our Platform utilizes artificial intelligence services provided by third-party developers and technology providers (such as OpenAI, Anthropic, or other AI service providers). You acknowledge and understand that:
- We do not develop or control the underlying AI algorithms, models, or AI services used on our Platform
- AI services are provided by external third-party developers and technology companies
- We integrate these third-party AI services into our Platform to provide analysis and recommendations
- The AI models, their training data, and their operational parameters are controlled by the third-party providers, not by PsyTest.health
7.2 AI Analysis and Recommendations
Our Platform uses artificial intelligence to analyze test results and provide recommendations. You understand that:
- AI analysis is based on algorithms and patterns, not human clinical or diagnostic judgment
- AI recommendations are suggestions and insights, not definitive conclusions about health, mental state, or medical conditions
- AI may make errors or provide incomplete analysis
- AI output may vary and is subject to the limitations and characteristics of the third-party AI services we utilize
- We continuously work to improve AI integration, which may affect the nature of recommendations
- All AI-generated insights are assessment tools that require human interpretation and judgment
- Final decisions and conclusions remain with the human user - AI provides data and suggestions, but does not make final determinations
7.3 No Responsibility for AI Output
CRITICAL UNDERSTANDING - AI OUTPUT DISCLAIMER:
You explicitly acknowledge and agree that:
- PsyTest.health does not bear responsibility for the content, accuracy, completeness, or nature of AI-generated analyses, recommendations, or insights
- AI output is provided "as is" from third-party AI services, and we cannot guarantee its accuracy, reliability, or appropriateness
- AI may produce errors, biases, incomplete analyses, or inappropriate recommendations due to limitations in the third-party AI models, training data, or algorithms
- You have full discretion to accept, reject, modify, or ignore any AI-generated output
- The decision to use or rely on AI output is entirely at your own discretion and risk
- You bear full responsibility for any decisions, actions, or conclusions you make based on or influenced by AI-generated content
- We are not liable for any consequences, outcomes, or decisions resulting from your use of or reliance on AI-generated analyses or recommendations

8. Corporate and University Use
8.1 Corporate HR
Corporate users agree to:
- Use test results in compliance with applicable employment laws, including but not limited to Title VII (US), Equality Act (UK), and similar anti-discrimination laws
- Not discriminate based on protected characteristics (race, color, religion, sex, national origin, age, disability, genetic information, etc.)
- Obtain necessary consents from test takers before administering tests
- Maintain confidentiality of test results in accordance with applicable privacy laws
- Understand that test results are assessment tools, not diagnostic conclusions
- Make all final hiring and recruitment decisions based on human judgment, using Platform results as supplementary assessment data
- Not rely solely on Platform results for final candidate evaluation - results should be one factor among many in the decision-making process
- Recognize that the Platform does not determine candidate suitability - all such conclusions remain the responsibility of qualified HR professionals
- Use test results in conjunction with other evaluation methods (interviews, references, work samples, etc.)
- Comply with all applicable employment, privacy, and data protection laws in your jurisdiction
- Not use test results as the sole basis for adverse employment actions (hiring, firing, promotion, demotion)
- Maintain proper documentation of how test results were used in decision-making processes
- Provide reasonable accommodations for test takers with disabilities, as required by law
HR Responsibility and Liability: Corporate HR professionals acknowledge that the Platform provides assessment data and evaluation insights to support their decision-making processes. However, all final conclusions about candidate suitability, hiring decisions, and organizational assessments remain the sole responsibility of qualified human HR professionals. The Platform is a tool that enhances understanding and provides data points, but does not make final determinations.
You agree that PsyTest.health and its developers are not responsible for:
- How you use, interpret, or apply test results in your hiring or employment decisions
- Any discrimination, adverse employment actions, or legal violations resulting from your use of the Service
- Any claims by candidates, employees, or third parties arising from your use of test results
- Your failure to comply with employment laws, anti-discrimination laws, or professional standards
You bear full responsibility and liability for all employment decisions made using or influenced by the Service, and you agree to indemnify PsyTest.health against any claims arising from such decisions.
8.2 University Partners
University partners agree to:
- Provide validated, ethically developed tests
- Comply with academic and research standards
- Respect intellectual property rights
- Use data in accordance with research ethics guidelines
9. Payment and Billing (if applicable)
If you purchase services or subscriptions:
- All fees are stated in the currency specified at the time of purchase
- Fees are non-refundable unless required by law or as specified in our refund policy
- We reserve the right to change prices with 30 days' notice
- You are responsible for any taxes applicable to your purchase
10. Disclaimers and Limitations of Liability

Test results and AI-generated analyses are:
- Assessment and evaluation tools for informational and professional purposes only
- Supplementary data points to support human decision-making
- NOT substitutes for professional medical, psychological, or clinical evaluation
- NOT diagnostic conclusions about health, mental health, or medical status
- Subject to human interpretation - all final conclusions remain the responsibility of qualified professionals or informed users
All final, key decisions and conclusions must be made by humans, not by the Platform or its AI systems. The Platform provides insights and assessment data, but ultimate judgment in recruitment, personal development, or any other context remains with the human decision-maker.

10.3 Third-Party AI Services Disclaimer
NO RESPONSIBILITY FOR THIRD-PARTY AI OUTPUT:
You acknowledge and agree that:

- We do not develop, control, or own the AI algorithms, models, or services used on our Platform
- We cannot guarantee the accuracy, reliability, completeness, or appropriateness of AI-generated content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSYTEST.HEALTH, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
SPECIFICALLY, WE SHALL NOT BE LIABLE FOR:
- Any errors, inaccuracies, biases, or inappropriate content in AI-generated analyses, recommendations, or insights
- Any decisions, actions, or consequences resulting from your use of or reliance on third-party AI output
- Any limitations, failures, or issues with third-party AI services integrated into our Platform
- Any outcomes based on AI-generated content that you choose to accept or act upon
- Any hiring, employment, or business decisions made based on test results or AI output
- Any discrimination, adverse employment actions, or harm to individuals resulting from use of the Service
- Any medical, health, or clinical decisions made based on test results or AI output
- Any legal consequences, litigation, or regulatory actions arising from your use of the Service
- Any violations of employment laws, anti-discrimination laws, privacy laws, or professional standards by users
- Any misuse, misinterpretation, or inappropriate application of test results or AI recommendations
- Any claims by third parties (test takers, employees, candidates, etc.) arising from your use of the Service
- Any data breaches or security incidents caused by third parties, user negligence, or factors beyond our reasonable control
- Any loss or corruption of data due to technical failures, third-party services, or user actions
- Any service interruptions, downtime, or unavailability of the Platform
- Any incompatibility between the Service and your systems, software, or devices
NO WARRANTY: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
IN NO EVENT SHALL OUR TOTAL LIABILITY (INCLUDING THAT OF OUR DEVELOPERS, EMPLOYEES, AND PARTNERS) EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification
You agree to indemnify, defend, and hold harmless PsyTest.health, its developers, officers, directors, employees, contractors, partners, licensors, and service providers from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another (including privacy, intellectual property, or civil rights)
- Your content, conduct, or submissions
- Your decisions, actions, or conclusions based on test results or AI-generated content
- Your use of test results or AI output in hiring, employment, medical, legal, or other critical decision-making contexts
- Any discrimination, harm, or adverse consequences resulting from your use of the Service or its results
- Your violation of employment laws, anti-discrimination laws, privacy laws, or professional standards
- Your misuse of the Service for purposes it was not designed for (e.g., clinical diagnosis, legal evidence, medical treatment)
- Any claims by third parties (including test takers, employees, candidates, or other users) arising from your use of the Service
- Your failure to obtain necessary consents, authorizations, or professional evaluations
- Your breach of confidentiality or privacy obligations
This indemnification obligation will survive termination of your account and these Terms.
You acknowledge that PsyTest.health and its developers are not responsible for how you use, interpret, or act upon information provided by the Service, and you bear full responsibility for all consequences of such use.
12. Termination
12.1 By You
You may terminate your account at any time by contacting us or using account deletion features (if available).
12.2 By Us
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- You engage in fraudulent, abusive, or illegal activity
- You misuse the Service in any prohibited manner
- You use the Service in a way that creates liability or risk for PsyTest.health or its developers
- You violate any applicable laws or regulations
- You breach confidentiality or privacy obligations
- We are required to do so by law, court order, or regulatory requirement
- We discontinue the Service
- We determine, in our sole discretion, that your use of the Service is harmful, inappropriate, or violates the rights of others
We reserve the right to refuse service, terminate accounts, or limit access to the Service at our sole discretion, without liability to you.
12.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and data in accordance with our Privacy Policy and applicable laws
- You remain responsible for all obligations and liabilities incurred prior to termination
- All provisions of these Terms that by their nature should survive termination will survive, including but not limited to: indemnification, limitation of liability, intellectual property, and dispute resolution provisions
- You may not create a new account to circumvent termination
Termination does not relieve you of any liability or obligations that arose prior to termination, including but not limited to indemnification obligations.

These Terms are for the benefit of you and PsyTest.health only. Nothing in these Terms creates any rights for third parties, including but not limited to test takers, candidates, employees, or other users. Third parties may not enforce any provision of these Terms.
Test takers, candidates, and other third parties have no rights against PsyTest.health or its developers arising from your use of the Service or your decisions based on test results.

17.1 Notice Requirements
Any notice required or permitted under these Terms must be in writing and delivered to the address above, or via email to legal@psytest.health. Notices will be deemed received when actually delivered or, if sent by email, when the email is sent (unless the sender receives a delivery failure notice).
You agree that we may provide notices to you via email to the address associated with your account, and such notices will be deemed received when sent.
18. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network or equipment failures, third-party service failures (including AI service providers), internet failures, or any other cause beyond our reasonable control.
In the event of such circumstances, we will use reasonable efforts to resume performance as soon as practicable.
19. Assignment
You may not assign, transfer, or delegate these Terms or any of your rights or obligations hereunder without our prior written consent. Any attempted assignment in violation of this provision will be null and void.
We may assign, transfer, or delegate these Terms or any of our rights or obligations hereunder without your consent, including in connection with a merger, acquisition, reorganization, or sale of assets.
